How property auctions work in Puerto Rico
The cheapest way to buy and the riskiest. What you are actually bidding on, and what you cannot find out beforehand.

Two very different kinds of auction
A judicial auction (subasta judicial) is the court-ordered sale that ends a foreclosure. It is announced publicly, held on a set date, and the winning bidder takes the property subject to whatever encumbrances survive the sale.
An online auction platform is a different animal: the property is already bank-owned, and the auction is just the sales method. These are far safer, because title has usually been cleared already.
Know which one you are bidding in. The risk profiles are not comparable.
What you usually cannot do
- Go inside. Most auction properties cannot be inspected before the sale.
- Back out. Deposits are typically non-refundable once you win.
- Get a normal mortgage. Many auctions require cash or a very short closing window that conventional financing cannot meet.
- Assume the property is empty. It may be occupied, and removing occupants is your responsibility afterwards.
Homework that is worth doing
- Pull the property's record at the Registro de la Propiedad and check for liens that survive the auction.
- Check CRIM for unpaid property taxes.
- Drive by. You cannot go in, but you can see the roof, the neighborhood, road access and whether anyone appears to be living there.
- Set a hard maximum before bidding and write it down. Auction rooms are designed to make you exceed it.
Who auctions are actually right for
Auctions favor buyers with cash, local knowledge and tolerance for surprises — typically investors doing this repeatedly, where one bad outcome is absorbed by several good ones.
If this is your first purchase, or the home you plan to live in, a bank-owned property or a HUD home gives you most of the discount with a fraction of the risk. There is no prize for choosing the hard path.
