The deed, the notary and the Property Registry

How a purchase legally becomes yours in Puerto Rico — and why the notary here is not what a mainland buyer expects.

A notary here is an attorney

On the U.S. mainland a notary public witnesses signatures and charges a few dollars. In Puerto Rico, which follows civil law tradition, a notary is a licensed attorney who drafts the deed, verifies the title, confirms the parties have the right to sell, and bears legal responsibility for the transaction.

This is the single most important professional in your purchase, and the fee reflects that. Choosing one on price alone is a poor idea.

What the deed does and does not do

The escritura is the notarized document that transfers ownership. Signing it makes the sale legally effective between you and the seller.

But until it is recorded at the Registro de la Propiedad, the transfer is not effective against third parties. That gap is where problems live: an unrecorded deed leaves you exposed to claims from people who were not part of your transaction.

The Registry, and the waiting

Recording is not instant. Depending on the section handling your municipality, it can take months. This is normal here and not a sign that something went wrong.

During that wait you own the property in practice and can live in it. Just do not treat recording as a formality to chase later — follow up until it is done, and keep the receipt showing the deed was presented.

Questions worth asking your notary

  • Is the title clean, and is there anything pending in the Registry on this property?
  • Does the property owe CRIM property tax?
  • Does the Registry description match what I am actually buying?
  • Are there liens, easements or rights of way recorded against it?
  • What is the total cost, itemized, including stamps and recording fees?
